1. Definitions
"Users/You/He/She" shall mean the users of the Website collectively; "Product" mean a product displayed on the Website; "Personal Detail" means the details provided by a user on registration; "We/us/our" means Bluelilys internet private limited; "Website" means the website with the domain name www.bluelilys.com or any subsequent URL which may replace it; "Cookies" means small text files which our Website places on your computer's hard drive to store information about your shopping session and to identify your computer; "Product category" means the type of product. "Conditions" means these terms and conditions and the Special Conditions;
2. Order Process
User can search for a product or visit the category page and then select the product he/she likes. User has the option to add the product to basket and then checkout to buy the product. New users have to provide their personal detail inorder to complete the order. Once the order is placed you’ll be given an Order Reference Number and details of the products (and/or services) you have ordered. We take payment from your card, when we process your order and have checked your card details. Products are subject to availability. If we are unable to supply the products, we will inform you of this as soon as possible and a full refund will be given if you have already paid for the products. If everything is fine we will send an email for 'Order Confirmation'. This email lets you know how your products will be delivered to you. If we have to cancel all or part of your order for any reason, we will email you to let you know.
3. Payment
Payment may be made by selecting the available payment method on the site, we will be unable to process orders if the payment is made using credit/debit from other countries other than India. A delivery charge will be applied at checkout if your order is less than 500 rupees, We do our best to make sure that prices are correctly shown but very occasionally an error may occur. We will not accept an order if there is a pricing error.
4. Delivery
We deliver to any address in Ernakulam district of kerala in the first phase of our operation and subsequently we will extend our delivery services to all over India. We will inform you if we have any concerns in delivery after you place the order. All cash on delivery orders requires a verification to be completed. For this verification we may call you to confirm the order details. All Orders generally require a signature to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person, to whom the order is addressed. If no one is available to accept the delivery you will receive a card to advise that a delivery has been attempted. For Collect from collection centre orders you must collect your order no later than 7 days after receiving your 'Order Ready for Collection' update email. Order details and proof of identity must be produced. It is your responsibility to ensure the delivery address is correct and able to accept delivery of the product, in particular that there is space for any delivery vehicle to make the delivery. We shall have no liability to you in respect of any delay or failure to deliver a product due to circumstances beyond our reasonable control, including (without limitation) delay or failure caused by adverse weather, strikes or transport problems.

7. Missing, damaged or incorrect orders
We makesure that your order arrives complete and great condition at your end. If you don’t receive all of your products at once, you can check that they have been dispatched using our tracking facility detailed in the confirmation email. If it’s not on its way, you can contact us Via the Contact Us facility on the Customer Services page or telephone 180030005167. In the unlikely event that the product is faulty, please write to us stating the fault or issue or email us. We will get back to you with 48 hours. Please refer the returns and refunds section to check if you are eligible for refunds.
8. Our liability
If we do not deliver or if the Products we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, our only obligation will be as mentioned below:
a) Make good any shortage or non-delivery or incorrect delivery; or replace or repair any Products that are damaged or defective; or refund to you the amount paid by you for the Products in question.
b) We shall have no liability to you for any consequential, special or indirect losses including without limit loss of revenues, profits, contracts, business or anticipated savings damage to or loss of goodwill, reputation or data.
c) Without prejudice to the foregoing, our total aggregate liability to you under and/or arising in relation to this contract shall not exceed the amount paid by you for the Products. Nothing in this contract shall exclude or limit our liability for death or personal injury due to our negligence or any liability which is due to our fraud or any other liability which We are not permitted to exclude or limit as a matter of law. Nothing in this contract shall exclude or limit your statutory rights.
d) A person who is not a party to this Contract has no right under the Contracts to enforce any term of this Contract.
9. Indemnity
You agree to indemnify, defend and hold harmless Bluelilys internet private Limited, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your breach of these terms and conditions, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.
10. Communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. Notice will be deemed received and properly served immediately when posted on our website, 48 hours after an e-mail is sent, or five days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

13. Declined Transactions
bluelilys.com reserve the right to recover the cost of goods, collection charges and lawyers' fees from persons using the Website fraudulently. bluelilys.com reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or acts or omissions in breach of these terms and conditions.

We have made every effort to display the colours and view of our products on the Website as accurately as possible. However, as the actual colours and view you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

19. Offers & Discounts
a) All offers and discounts are applicable only on the time frame mentioned
b) Customers are not entitled to get multiple discounts on the same order. If one or more products are in a discounted price in one order then you are not eligible to get other discounts on the same order.
c) Customers are not allowed to use multiple voucher codes in the same order.
20. GENERAL
a) We will not be liable for any loss, damage or penalty as a result of any delay in or failure to deliver or otherwise perform hereunder due to any cause beyond the our control, including, acts of the End User,governmental act, regulation or request affecting the conduct of bluelilys.com 's business, fire, explosion, accident, theft, vandalism, riot, acts of war, strikes or other labor difficulties, lightning, flood, windstorm or other acts of God.
b) These terms, constitute the entire terms on which we will provide products to you and cancel and supersedes all prior arrangements and representations, whether verbal or written.
c) No waiver by either party of any breach or default hereunder is a waiver of any preceding or subsequent breach or default. The failure of either party to exercise any of its rights under this Agreement shall not be deemed a waiver or forfeiture of such rights or any other rights provided hereunder.
d) You may not assign or sub-contract any of your rights or obligations under these terms to any person without our prior written consent. No third party shall be entitled to enforce any of these terms whether by virtue of the Contracts
e) Neither the Content, the Trade Marks nor any other portion of the Website may be used reproduced duplicated copied sold resold accessed modified or otherwise exploited in full or in part for any purpose without our prior written consent.
f) This Agreement will be governed by laws of India, subject to the Courts in Cochin, without reference to conflict of laws principles, if any.
g) We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
